Just when the dust seemed settled, advocates of the proposed tiger sanctuary in Ventura County just west of Malibu have re-opened the case, filing suit to overturn the decision against the facility.

Irena Hauser, who claims years of experience working with tigers, was denied the conditional use permit (CUP) to build a tiger training and housing facility in March and then lost a June appeal. This will be her third attempt to obtain permits for the tiger sanctuary.

On July 14, Hauser filed an appeal against the Ventura County Board of Supervisors, asking for a reversal of the original decision.

“The decision of the Board must be reversed and remanded,” reads the suit, which cites "deprivation of fair hearing" and "abuse of discretion" as the basis for the appeal.

The Ventura County Superior Court will now take the case, which was filed by Casselman Law Group on behalf of Hauser.

Hauser and her sister Sophia Kryszek seek a permit to construct a 13,500-square-foot exercise arena and enclosures. Hauser and her family tout years of experience training and working with the tigers. Hauser and Kryszek own ISIS Preservation, which supplies the white tigers for filming in the entertainment industry. 

The sanctuary is controversial in Malibu and southern Ventura County, where many residents fear the tigers could pose a threat to native wildlife, as well as the people and pets living nearby.

Only the white tiger in this video belongs to Isis Preservation. The other tigers, alligator, snake, bear belong to other people. It was a bit irresponsible of the video crew to all those other images. Dumped unwanted alligators and snakes have nothing to do with this situation.

The two real estate "experts" don't know what they are talking about. The Playboy Mansion has a zoo. Ellen Degeneres bought the home next door few months ago for $35 million. She just sold it for $50 million. The Playboy Mansion's zoo did not affect the property value. Some of their animals freely roam the compound. Currently there are wild mountain lions, coyotes, bobcats, foxes, raccoons... around the property. That has not affected the property value either.

Barbara Corcoran is not a real estate agent, broker or appraiser. She is a TV personality who lives in New York. She is not a real estate "mogul." She had a business which she sold which wrote about real estate trends. She knows nothing about animals or how they related to property values.

Daniel Irwin Bercu at 11345 PACIFIC VIEW DR, MALIBU, CA 90265 is a real estate broker since 1992. What he said is completely untrue. Currently almost all the neighbors have horses, dogs and other farm animals. Statistics show you're more likely to be attacked and killed by a horse, dog or other farm animal than a tiger. A home next door to a property with an animal enclosure would not be worthless.

"Back now at 7:42. Outraged homeowners in a wealthy malibu neighborhood fighting to prevent their neighbors from keeping tigers in their backyard. The neighbors say they're not breaking any laws but the homeowners needless to say feel it's a risk to their safety and also their property value. That is know not a tiger. They got more than tiger. ABC's Rebecca Jarvis will tell you more. ? Reporter: High above malibu, California, amidst the cliffs and views is a rustic neighborhood called deer park. Nanette and Dan thought their home here was their castle. Until one day they say something reared its ugly head. The threat is something they never anticipated. Ooh. Reporter: A white siberian tiger, trainers irina Howser and Sophia creshak brought one in a temporary cage to show us. Around this entire area would be a perimeter fence with barbed wire on top. Reporter: The sisters thought it would be a formality to get a permit to permanently keep the tigers on their property. They thought wrong. They are our closest neighbors and a tiger can get here in 30 seconds. Reporter: The family lives a few hundred yards away. We're a young family. Last thing we want to worry about is tigers getting lose and eating our children. Reporter: They weren't the only ones upset. Signs went up all along the roadside. Deer creek not tiger creek. Appeal hearing before the Board of Supervisors today

We will be posting video from the appeal hearing today at the Board of Supervisors as soon as it is available.

Before the meeting started the lobbyist most likely paid by Lisa Siderman named Cheline Lundin put stickers on 2/3 of the chairs in the room. This caused there not to be enough room for Isis Preservation supporters to fit in the room. Some sat outside in the lobby and viewed the meeting on the tv screens.

Before the meeting an elderly woman with white hair came over to the supporters side and said "No tigers! No Russians!!!" directly in the face of Irena, Sophia and their lawyers. This same person whom I will name when I am 100% positive of her name then confronted a supporter physically. Security had to repeatedly warn this old white hair woman to control herself or she would be ejected and could be jailed. Before the hearing in the lobby these people stated that "someone should pick them off with a sharp shooter," "these people will never be our neighbor." During the meeting they stated that people might "cut open the cages and free the tigers."

At a previous hearing Planning Commissioner stated she would be able to see the roof of the enclosure from the Serrano horse trail. This was a bold face lie. There is no place on the trail where one could see the roof. Today Lisa Siderman showed photos stating you could see the side of the house from 1.2 miles away and below the structure. This proves Commissioner Nora Audukis lied when she stated she'd be able to see the roof. The side of the house will always be visible no matter if there are enclosures or not. The Hausers offered to put camoflague netting and add more trees need be.

Many other similar and very disgusting things happened before the hearing and afterward. These included falsified emails, defamation, libel, slander, threats to children and much much more.

One interesting thing came up today. It turns out Irena is an aerospace engineer who graduated from UCLA cum laude. She worked on the docking mechanism of the Space Shuttle. More tomorrow.

We do not know the plans of Isis Preservation at this time. We do know that one must appeal a Planning Commission decision to the Board of Supervisors. The BOP are voted in. They are not appointed. Therefore the BOP would want to do what what most people in Ventura county who can vote want to do. The case cannot be appealed to the State level until after it's appealed and denied by the BOP.

One last interesting thing was that the eight year old son of a supporter noted today that the detractor's logo is in fact a double negative. This means their logo actually means "yes, tigers."

Carlos Siderman President of Property ID and Deer Creek Ranch Malibu was reported by multiple individuals to government agencies for illegally bulldozing a protected creek and oak trees in the Coastal Zone in Malibu, California. Carlos Siderman is currently under investigation by Ventura County planning, zoning and the coastal commission.

Through the results of State Information Act Requests it was revealed that multiple individuals have reported Carlos Siderman to authorities for bulldozing a protected creek and oak trees. Carlos Siderman was reported December 2013, March 2014 and on other dates. Carlos Siderman was also reported for running an illegal business on the same residential property. In order to run a business in a residential zone he would need a conditional use permit which he does not have.

The December 2013 complaint CV13-0505 states Carlos Siderman "Brush or vegetation removal (oak trees)and grading without required planned development permits." (pdfhttps://drive.google.com/file/d/0B6QQek7gVUpyVl84ZlhnRWVrSkE/edit?usp=sharing )

March 2014 another complaint was made for "illegal removal of oak trees, bulldozing a running creek on protected coastal zone, running a business in a residential zone without a conditional use permit and illegal signs." Carlos Siderman currently runs Deer Creek Ranch Malibu from a residence located at 10995 Pacific View Drive, Malibu California 90265. Deer Creek Ranch breeds, sells, boards, horses, goats and ducks besides offering horse rides off trail in the Santa Monica mountains to prospective horse buyers. Neighbors believe that Carlos Siderman bulldozed the creek so he could ride his horses across his neighbor's property and into the protected Santa Monica mountains. Carlos Siderman and his wife Lisa Siderman have been seen riding on this illegally created horse trail into the protected Santa Monica mountains off trail.

Earlier this year Carlos Siderman and his wife Lisa Siderman paid a lobbyist to try to harass their neighbor into moving. It seems Carlos Siderman has eyed his neighbor's property for many years so he can go across it to access the Santa Monica mountains on his horses. He also wants to have prospective horse buyers ride on these same off trail areas.

While investigating this land situation the true history Carlos Siderman has come to light. He and his business Property ID were sued by the Department of Justice, Department of Housing Urban Development and class action plaintiffs for violations of Real Estate Settlement Procedures Act of 1974 ("RESPA"). Carlos Siderman was found guilty of giving illegal kick backs in real estate transactions. HUD forced Carlos Siderman to pay a $7.5M fine which is disgorgement of ill gotten gains.

"WHEREAS, RESPA § 2607(a) prohibits the giving or accepting of any fee,
kickback, or thing of value pursuant to any agreement or understanding, oral or
otherwise, that business incident to or part of a real estate settlement service
involving a federally related mortgage loan shall be referred to any person, and
§ 2607(b) prohibits the giving or accepting of any portion, split, or percentage of
any charge made or received for the rendering of a real estate settlement service
involving a federally related mortgage loan other than for services actually
performed;"

"WHEREAS, Property I.D. has agreed to pay $7,500,000, which will be
allocated among the three Berger settlement classes described above and which
will be available to pay Property I.D.’s NHDS report customers (hereinafter the
"Class Settlement")."

Because the illegal kickbacks, false advertising, unfair trade practices came to light his son left Property ID and started his own company. His son Sergio Siderman was then forced to sue his father Carlos Siderman for unfair and unlawful competition, defamation per se, trade libel, misappropriation of trade secrets, malicious prosecution, conversion, tortious interference with prospective economic advantage and false advertising. In that lawsuit Carlos Siderman's ex wife Mirta and his son Sergio made sworn declarations against Carlos Siderman. Mirta stated that Carlos Siderman lied when he said he started Property ID in 1974. Carlos Siderman's son Sergio also made a statement. Sergio Siderman states he worked at Property ID with his father Carlos Siderman from 1993 to 2007. I believe he meant 1995. Carlos Siderman fired his son when his son questioned certain business transactions and policies. After Carlos fired his son he defamed him. Sergio started his new business and Carlos tried to destroy it by defaming Sergio. Carlos went so far and so low as to send a defamatory flyer about Sergio's business to his clients. Sergio claims that Property ID made no profits in 2006 and 2007.

Sergio Siderman stated that Carlos Siderman lied when he said he is a lawyer. In actuality Carlos Siderman does not have a college or law degree. He most certainly never passed the bar. Sergio Siderman states that Carlos Siderman forged a law degree and hung it on his office wall. While researching further it was uncovered that Carlos Siderman's business partner in 1995 was none other than Horatio Vignali whom the LAPD and DEA suspected of being a major drug lord for over 20 years.

March 20, 2014 hearing minutes approved, Isis Preservation, Tiger Sanctuary Malibu

The minutes from the March 20, 2014 minutes were approved today. It was announced at the meeting viewed by video that Isis Preservation, Irena Hauser has indeed appealed the denial of the CUP to the Board of Supervisors. I will update when they release public information.

"The applicant has met every test. Environment report came back negative declaration, use permitted in the zone. We have no evidence to deny the conditional use permit, of a substantive nature. I don't think there is any real factual disputes that would stop me from voting FOR the applicant. The reason for that is a perfect safety record, people on site, no public access. I look at the conditions imposed and staff came up with standards that don't exist in the code. That is exactly what they've done and I feel sorry for the staff, and I understand why they jumped through hoops. No matter what happens today it should go back to board of supervisors for further study so guidelines can be set. I feel the restrictive conditions imposed by staff would be stronger than anything from the board of supervisors. A two year permit. If you think about it, if any real problems exist they will be discovered. This sound situation is, as residents think it might be, then they can come back also. There is no credible expert testimony upon which I can deny based on sound, and sound is one of the chief concerns that I have. <snip> We don't have substantive expert evidence upon which to deny the permit based on noise. It doesn't exist now. Staff denied based on public safety and compatibility. Well I didn't see any evidentiary substantive support to deny on public safety basis. As I said conditions exceed all standards. Safety record is perfect. On a compatibility issue I can't see any distinction between this one and Lockwood Valley. And I don't think we should have two standards, one for Malibu and one for Lockwood. I'm not saying there's not a lot of work that may need to be done with the "wild animals." But as everything exists today, as the record appears before me I have no choice but to vote to support the conditional use permit. I mean tigers, that is what this is about. Everybody is scared to death. Who wants a tiger next door? I appreciate that but it's actually permitted. All the conditions have been met and exceeded. So what are we supposed to do up here? Invent a problem so they can't go forward because we haven't done our job? I don't think so. I think what has to happen, we need to do our job. This matter needs to go back to the policy makers to clarify this issue. But I'm not prepared to stop the application because we haven't gotten direction from the policy makers. As I said all conditions have been met. We have a negative declaration. I can't find a public safety or compatibility issue. And I'm prepared to vote to approve the application."

Commissioner Michael Wesner stated "I concur with a lot of the information from my three colleagues and I wrestled with this one just like we did with Lockwood. So you understand the sieves that I use to go through the process. Property owner acquires the property. That property is subject to zoning and terms and conditions it has at time they acquired it. Part of that is they are in open space and they are permitted to have wild animals. Therefore then our standards stop. So first sieve they met. Second sieve. They apply for a conditional use permit which is their right under our codes. And that conditional use permit, staff does analysis. Does it meet certain criteria, elements, which they have laid out in the staff report. Then we receive testimony both for and against, day and a half now, almost 1000 pages, several hours. Yes, we're not the experts in biology, in a lot of things but that's the reason we exist. We have experts. We have public testimony. We are the ones that make the decision. What we are relying on is to be this average citizen. Yes, we bring our own expertise, background, whether it be waste management or security. But sadly the buck stops here, and that is what we get paid to do. So it's not an easy decision. I agree with the other commissioner. I wouldn't want it next to me. But at the same time I'm not out in open space. Lockwood set the precedent. Here are standards. We apply standards. Property owner has right to expect standards. And when it comes to a conditional use permit is it reasonable to expect standards can be met? Best management practices, qualifications of state, federal requirements for these particular animals, track record, history of the applicants, has documents, and we put this in a sieve. It comes down to do we want a pack of wolves or 2-5 tigers. So the question gets to the point, is there truly a question of public safety that staff has represented? In the capacity question is there enough evidence, information to sway my decision one way or another? And I go back to not only what the applicant's attorney represented but what my fellow commissioners have said. We have evaluated wild animals being contained and applied standards and best practices. So I'm really 51%, 49% here but if I'm going to go with the situation through the sieves I've gone through I would have to approve the conditional use permit based on the current standards of the situation that exist before this body today."
