Just when the dust seemed settled, advocates of the proposed tiger sanctuary in Ventura County just west of Malibu have re-opened the case, filing suit to overturn the decision against the facility.

Irena Hauser, who claims years of experience working with tigers, was denied the conditional use permit (CUP) to build a tiger training and housing facility in March and then lost a June appeal. This will be her third attempt to obtain permits for the tiger sanctuary.

On July 14, Hauser filed an appeal against the Ventura County Board of Supervisors, asking for a reversal of the original decision.

“The decision of the Board must be reversed and remanded,” reads the suit, which cites "deprivation of fair hearing" and "abuse of discretion" as the basis for the appeal.

The Ventura County Superior Court will now take the case, which was filed by Casselman Law Group on behalf of Hauser.

Hauser and her sister Sophia Kryszek seek a permit to construct a 13,500-square-foot exercise arena and enclosures. Hauser and her family tout years of experience training and working with the tigers. Hauser and Kryszek own ISIS Preservation, which supplies the white tigers for filming in the entertainment industry.

The sanctuary is controversial in Malibu and southern Ventura County, where many residents fear the tigers could pose a threat to native wildlife, as well as the people and pets living nearby.

March 20, 2014 hearing minutes approved, Isis Preservation, Tiger Sanctuary Malibu

The minutes from the March 20, 2014 minutes were approved today. It was announced at the meeting viewed by video that Isis Preservation, Irena Hauser has indeed appealed the denial of the CUP to the Board of Supervisors. I will update when they release public information.

Tiger Sanctuary Malibu

Tiger Sanctuary Malibu is not Isis Preservation. We are not a lobbyist, public relations agency, marketing team or a social media firm. We are merely avid supporters of Isis Preservation, Irena Hauser and the wonderful work they do.

After a five year search Irena Hauser, Isis Preservation bought this property because it is zoned for wild animals, for tigers. There are no neighbors to the north for miles. There are only two neighbors to the west for miles. There are a few places nearby which already have tigers. She currently has all necessary permits (USDA, Fish & Wildlife) to have tigers in California. She has legally had tigers for 13 years in Los Angeles, California. She and her sister Sophia have many years of training and experience with tigers and other animals. They have a perfect history with all government agencies.

Irena Hauser applied for a conditional use permit (CUP). They met every single requirement necessary for the permit. The Ventura County Department of Planning gave them a negative declaration. This means the project will not negatively affect the environment, neighborhood or neighbors.

Their neighbor Carlos Siderman runs a business next door called Deer Creek Ranch Malibu. He breeds, boards and sells goats, horses and ducks. This is a residential zone. He cannot have a business without a CUP. He does not have a CUP. He would need Irena to agree to his CUP.

Carlos Siderman previously tried to buy this property but was denied. We believe he wants this property so he can illegally access the California state park on his horses. It's illegal to ride off trail in the park.

There is (was) a protected creek that runs between the two properties. This is a coastal area so all waterways, brush, oak trees are protected. Even though Siderman knew the creek was protected he bulldozed it, removed the brush and oak trees. He created a 15' wide half a mile long horse trail leading over Irena Hauser's property into the state park.

After Carlos Siderman heard Irena Hauser received a negative declaration and could proceed with the project Siderman hired a public relations firm to lobby against the project. This firm spread lies, propaganda and defamation about Irena and Isis Preservation via flyers, signs, protests, blogs, pages and media articles. They even made tshirts and hats saying "No Tigers!"

The lobbyist contacted organizations and politicians giving them totally false information asking them to write letters against the project. The lobbyist lied and told people they beat their animals, declaw them, breed them, the animals won't be enclosed... The animals are spayed, not declawed, they give them the best care and the animals will be in enclosures.

Because of the paid lobbyists spreading false information the Ventura County Planning Commission did a complete 180 degree turn. Even though the Department previously said the project met all requirements the Commission voted 3 to 2 against the project. Commissioners Michael Wesner and Stephen Onstot both voted FOR the CUP stating there is absolutely no reason why they should be denied. They met every single requirement and did absolutely everything the Department asked them to do. It was noted that Commissioner Nora Aidukas' husband works for Carlos Siderman. She should have recused herself but did not. She did not even disclose this before the March 20, 2014 meeting.

This blog is about the appeals process to the Board of Supervisors. We have posted the negative declaration, application, power point presentations, expert reports and letters of support. We also posted video from the hearings. We post all these things to see justice for Irena and Isis Preservation.
